Brainiacs: Injunctive Relief
In Project: Brainiacs

June 2015:  Injunctive Relief may be the answer to the long winding road that has been Paula's effort to get the worker's comp benefits that supposedly any injured worker in Colorado should be able to access.  What Paula did not know is that in some cases it is not necessary to "exhaust all state remedies" when there is (1) irreparable damages, (2) evidence indicating the claimant should win in the long run, (3) continuing to exhaust state remedies would be futile, (4) there is no adequate legal remedy available, (5) the balancing test between plaintiff and defendant on irreparable harm is in the plaintiff's favor, and probably others.

KNOWING that Rule 107 for contempt indicates state employees of the Office of Administrative Courts may incarcerate claimants for behavior they subjectively consider offensive (without a hearing) and the OAC'S penchant in the past for inventing false criminal complaints where there are no videocameras and where clerks may also get financial incentives via C.R.S. 8-42-113 to send claimants to prison, Paula thinks entrapment is the biggest obstacle to returning to the OAC.

So ... OAC or U.S. Supreme Court?
