Commentary: Overcoming State Preemption of Broadband

State Preemption Laws have been promoted by the American Legislative Exchange Council to advance an ideological right wing agenda, to preempt everything from Gun Safety laws to prohibition of Factory Farming. Communication Companies including Comcast lobbied the Colorado legislature in 2005 to pass a preemption law prohibiting the institution of local broadband. Since then, various communities have passed ballot initiatives to opt out of the 2005 broadband preemption law. In 2020 Denver ballot initiative 2H was passed to permit establishment of broadband in Denver.
